People v. McDuff and Lucas, No. GC98A26 (consolidated with No. GC98A28), 7/30/99. Attorney Regulation. The Presiding Disciplinary Judge accepted the parties’ Conditional Admission of Misconduct and suspended the respondents, Kathleen S. McDuff and Richard M. Lucas, from the practice of law for a period of two years subject to certain conditions. Respondents commingled client, personal and business funds in violation of Colo. RPC 1.15(a); delayed in paying expenses incurred on behalf of clients, made misrepresentations regarding payroll taxes, and issued insufficient funds checks for items including court costs in violation of Colo. RPC 8.4(a), Colo. RPC 8.4(c), Colo. RPC 8.4(d), and Colo. RPC 8.4(h). Respondents were ordered to pay the costs of the disciplinary proceedings.
