People v. McCarthy. 12PDJ034. August 29, 2012. Attorney Regulation. The Presiding Disciplinary Judge suspended Sean Michael McCarthy (Attorney Registration Number 20499) from the practice of law for a period of three years, effective October 3, 2012. McCarthy failed to exercise the requisite diligence in representing two clients and also neglected to communicate with those clients. In addition, he assumed possession of client funds without having earned the funds and then failed to complete the work his clients had hired him to perform. In doing so, he recklessly breached his duties of honesty and integrity. McCarthy’s misconduct constitutes grounds for the imposition of discipline pursuant to C.R.C.P. 251.5 and violated Colo. RPC 1.3, 1.4(a)(3), 1.4(a)(4), 1.15(a), 1.15(b), 1.15(d), 1.15(j), 1.16(d), and 8.4(c).
