People v. Howarth. 08PDJ081. September 3, 2008. Attorney Regulation. The Presiding Disciplinary Judge approved a Conditional Admission of Misconduct submitted by the parties and suspended Bernard McDonald Howarth (Attorney Registration No. 18844) from the practice of law for a period of six months, with the requirement of reinstatement proceedings pursuant to C.R.C.P. 251.29(c)-(i), effective October 3, 2008. Following an incident on September 19, 2007, Respondent was charged with DUI and third-degree assault. He later pled guilty to the third-degree assault charge and the DUI charge was dismissed. Respondent was sentenced to supervised probation with conditions including compliance with a protection order. He later pled guilty to violating the protection order. Respondent’s misconduct constituted grounds for the imposition of discipline pursuant to C.R.C.P. 251.5 and violated Colo. RPC 8.4(b) and C.R.C.P. 251.5(b).
