People v. Thomas Eugene Henry. 15PDJ014. March 2, 2015. The Presiding Disciplinary Judge approved the parties’ conditional admission of misconduct and suspended Thomas Eugene Henry (Attorney Registration Number 04504) from the practice of law for sixty days, all stayed upon the completion of a one-year period of probation. The probation took effect March 2, 2015.
In two separate client matters, Henry failed to advise his clients in writing of the basis or rate of his legal fee. He thus violated Colo. RPC 1.5(b) (a lawyer shall communicate, in writing, the basis or rate of the fee and expenses within a reasonable time after commencing representation, if the lawyer has not regularly represented the client). A stayed period of suspension, rather than a public censure, is warranted for this misconduct because Henry has an extensive record of prior discipline.
