People v. Gray. 09PDJ069. July 21, 2009. Attorney Regulation. The Presiding Disciplinary Judge approved a Conditional Admission of Misconduct submitted by the parties and suspended Kenneth Holbrook Gray (Attorney Registration No. 19054) from the practice of law for a period of thirty days, all stayed upon the successful completion of a two-year period of probation, effective July 21, 2009. In one client matter, Respondent failed to diligently represent his clients and failed to provide a written statement of the basis and/or rate of his fee at the outset of the representation or an accounting of the use of the retainer. In a second client matter, Respondent placed a retainer fee in his operating account, failed to provide his client with a written statement of the basis and/or rate of his fee or an accounting of the use of the retainer. Respondent’s misconduct constituted grounds for the imposition of discipline pursuant to C.R.C.P. 251.5 and violated Colo. RPC 1.3, 1.5(b), 1.15(a) and 1.15(c).
