People v. Cabral. 09PDJ055. August 21, 2009. Attorney Regulation. The Presiding Disciplinary Judge approved a Conditional Admission of Misconduct submitted by the parties and suspended Alfonso S. Cabral (Attorney Registration No. 18328) from the practice of law for a period of sixty days, all stayed upon the successful completion of a two-year period of probation with conditions, effective September 21, 2009. In one client matter, Respondent failed to adequately supervise his staff, which caused him to fail to appear at his client’s first court appearance and then fail to appear at his own contempt hearing. In a second client matter, Respondent communicated with a party represented by counsel and failed to adequately supervise his staff when they communicated directly with the party. Respondent also failed to competently represent his client by misinterpreting a court order, which resulted in the filing of a frivolous motion for contempt against the opposing party. Respondent’s misconduct constituted grounds for the imposition of discipline pursuant to C.R.C.P. 251.5 and violated Colo. RPC 1.1, 3.1, 4.2, 5.3(a), 5.3(b), and 8.4(d).
