People v. Byrne. 13PDJ061. August 19, 2013. Attorney Regulation. The Presiding Disciplinary Judge approved a conditional admission of misconduct submitted by the parties and disbarred John Charles Byrne (Attorney Registration Number 18327) from the practice of law, effective August 19, 2013. In 2005, Byrne was appointed trustee and fiduciary for his mother-in-law, a nursing home patient suffering from dementia. Acting as his mother-in-law’s fiduciary and trustee, Byrne stole over $578,000.00 from her. Byrne pled guilty to class-four felony and class-one misdemeanor theft charges. He was sentenced to six years in prison and was ordered to pay $916,028.03 in restitution. Byrne's misconduct constitutes grounds for the imposition of discipline pursuant to C.R.C.P. 251.5 and violated Colo. RPC 8.4(b) and 8.4(c).
