People v. Tuthill, No. 03PDJ111. June 7, 2004. Attorney Regulation. The Presiding Disciplinary Judge approved the parties’ Conditional Admission of Misconduct and suspended Respondent Timothy J. Tuthill, attorney registration number 19014, from the practice of law in the State of Colorado, effective July 8, 2004, for a period of one year and one day. Respondent agreed to assist Colorado clients with settlement negotiations and with obtaining representation to defend against a suit brought against them in the State of Washington. By providing incompetent representation and neglecting this and other matters, Respondent’s conduct left his clients without adequate representation and resulted in harm in violation of Colo. RPC 1.1 and 1.3. In another matter, Respondent knowingly assisted or induced his secretary to backdate pleadings and the corresponding certificate of filing for the pleadings. Through his secretary’s conduct, Respondent violated Colo. RPC 3.3(a)(1) and Colo. RPC 8.4(a) and (c). Respondent was ordered to pay the costs incurred in this proceeding.
