People v. Smith. 11PDJ016. July 12, 2011. Attorney Regulation. The Presiding Disciplinary Judge approved a Conditional Admission of Misconduct submitted by the parties and suspended Floyd L. Smith, III (Attorney Registration Number 8477) for a period of six months, all stayed upon the successful completion of a two-year period of probation, with conditions, effective July 12, 2011. Smith knowingly violated his duties of loyalty and conflict-free representation when, in a loan transaction, he acted in a representative capacity for the lender while simultaneously representing the debtor. His misconduct constitutes grounds for the imposition of discipline pursuant to C.R.C.P. 251.5 and violated Colo. RPC 1.7(a) (2007), 1.7(a) (2008), 4.3 (2007), and 4.3 (2008).
