People v. Sladek. 06PDJ008. July 11, 2006. Attorney Regulation. The Presiding Disciplinary Judge approved a Conditional Admission of Misconduct submitted by the parties and suspended Respondent Dennis James Sladek (Attorney Registration No. 17303) from the practice of law for a period of sixty-days, all stayed upon the successful completion of a one-year period of probation, with conditions, effective August 11, 2006. Respondent represented plaintiffs in a civil action against a lender and two individuals. Respondent initially could not find one of the individual co-defendants and later believed he had been dismissed pursuant to the language of a delay reduction order. Respondent subsequently located the individual co-defendant and without revealing the fact he represented the plaintiffs, contacted him, and misrepresented to him that he was interested in obtaining financing. At the meeting, Respondent interviewed the individual co-defendant and had him sign an affidavit related to the civil action without the presence of counsel. Respondent’s misconduct constituted grounds for the imposition of discipline pursuant to C.R.C.P. 251.5 and violated Colo. RPC 4.1, 4.3 and 8.4(c).
