The Presiding Disciplinary Judge approved a Conditional Admission of Misconduct submitted by the parties and publicly censured Gilbert O. Montoya, Jr. (Attorney Registration No. 08079), effective April 17, 2009. Respondent negligently failed to terminate an attorney-client relationship when he learned that his wife was involved with a business transaction with his client. He therefore effectively entered into a business transaction with his client without the appropriate disclosures. Respondent also failed to make reasonable efforts to ensure that his wife/employee’s conduct was compatible with his professional obligations. Respondent’s misconduct constituted grounds for the imposition of discipline pursuant to C.R.C.P. 251.5 and violated Colo. RPC 1.16(a), 1.8(a) and 5.3(b).
